Webinar on The Sedona Canada Principles Addressing Electronic Discovery, Third Edition (Public Comment Version)

Date: Thursday, May 6, 2021

Time: 1:00 p.m. EDT

Duration: 90 minutes

Electronic discovery, once consider a niche practice, is now firmly entrenched in Canadian civil litigation. The first edition of the Sedona Canada Principles Addressing Electronic Discovery was released in early 2008 and was immediately recognized by federal and provincial courts as an authoritative source of guidance for Canadian practitioners. It was explicitly referenced in the Ontario Rules of Civil Procedure and practice directives that went into effect in January 2010. The Second Edition of the Principles was published in November 2015. Since that time, there have been significant technological and societal changes that have changed how we manage eDiscovery. We have done our best to reflect those changes in the Third Edition, which is now published for public comment.

In this webinar, members of the editorial and drafting team of Working Group 7, Sedona Canada will provide an overview of what is new in the Third Edition and respond to your questions and comments. Among the topics to be covered are:

  • Privacy concerns in investigations and during preservation
  • Tiered/phased discovery planning
  • The role of information governance and records management
  • Updated case law
  • Ephemeral data issues
  • The pros and cons of key word searches
  • Cross-border privacy issues

The Sedona Canada Principles Addressing Electronic Discovery, Third Edition, is available free for individual download here. This is the ‘Public Comment Version,” and we welcome your questions and comments during the public comment period, which ends on 30 June 2021. Please join us for this webinar or submit your comments to [email protected].
