Tyler A. Baker

Tyler is co-chair of the Antitrust Group at Fenwick & West LLP, based in the Firm's Silicon Valley office in Mountain View, California. His practice includes all aspects of antitrust law. Because Fenwick & West LLP represents many high technology companies, Tyler frequently deals with the interface between antitrust and intellectual property. Earlier in his career, Tyler was involved in two developments that have shaped modern antitrust law. As a law clerk to Justice Lewis Powell, Tyler was the clerk principally responsible in assisting Justice Powell in drafting the Court's decision in Continental TV Inc. v. GTE Sylvania, Inc., 433 U.S. 34 (1977), which fundamentally changed the antitrust analysis of vertical restrictions. He later served in the Antitrust Division of the U.S. DOJ where he had primary responsibility for the 1982 Merger Guidelines, which fundamentally changed the antitrust analysis of mergers. In addition to his trial practice, Tyler counsels clients on transactional matters raising antitrust and other competition issues.
