The Top Electronic Discovery Decisions for 2010: Shaping the Future of Litigation

April 28, 2010     01:00pm - 02:30pm Eastern

Agenda

Panelists

Electronically-generated information is increasing exponentially on a daily basis. And, as electronic information is exploding, so is case law, civil and criminal, from both state and federal courts. This "Voices from the Desert" webinar will select and focus on decisions issued in 2010 that inform practitioners about the courts' powers to impose sanctions, the new Federal Rule of Evidence 502, evolving concepts of privacy and state search and seizure powers, international discovery, and other issues about which anyone seeking to keep abreast of legal developments in this area should be aware. A former federal judge and two sitting judges -- one from federal court and one from the nationally-respected Delaware Court of Chancery -- review their selections for the most intriguing recent cases on electronic discovery, discuss how these decisions will affect litigation going forward, and take your questions. The decisions to be considered, and the issues they raise, include:

- Rimkus and how courts consider scienter after Pension Committee
- Comprehensive Drug Testing, Williams, and the 4th Amendment implications of electronic information
- AccessData, Enquip, and discovering electronic information overseas
- Cornwell, forensic imaging, and confidentiality concerns
- Trustees of the Electrical Workers Local No. 26 Pension Trust Fund and Federal Rule of Evidence 502
- Mintel Internat'l Group and the (rare) trial of a case involving electronic information
- Lawson, Castellano, and Postorivo: the interplay of e-discovery and the Rules of Professional Conduct

Listeners will be provided with the full text of all the decisions discussed before the webinar.
