The Sedona Conference® International Overview of E-Disclosure, E-Discovery, and Transfers of Electronically Stored Information

The 21st century economy is increasingly global and information-based. Digital commerce streams across international borders. Large multinational enterprises operate in scores of countries simultaneously, and even small local businesses participate in an international market. On a routine basis, organizations find themselves subject to increasingly complex - and sometimes contradictory - regulatory requirements regarding electronic records retention, reporting, transfer, and privacy protection. When legal disputes arise involving data located in different jurisdictions, these everyday problems become more acute, as different legal systems place different requirements on the disclosure, transfer, or protection of data that are often in conflict.
Working Group 6 of The Sedona Conference® was established in 2005 to help lawyers, judges, and decision makers navigate the uncertain and potentially dangerous waters of cross-border electronic data transfer, particularly in the context of civil litigation. One of its activities is the creation and maintenance of an International Overview of Discovery, Data Privacy & Disclosure Requirements, a high-level overview of the law and practice in several countries. This month, the International Overview will be published in two forms - as a downloadable reference document, and also as a "wiki," an online, "evergreen" information resource to which readers will contribute under the supervision of expert editors. This webinar will introduce participants to the International Overview and invite their active involvement in its growth and refinement. In addition, members of Working Group 6 will bring participants up-to-date on significant developments in the law of cross-border data transfer for civil litigation, reporting on Working Group 6's recent public programme in Barcelona involving lawyers and data protection authorities from more then ten countries; advice from the EU Article 29 Working Party for data protection authorities regarding disclosure and discovery in civil litigation; and a very recent statement by French data protection authorities addressing pre-trial discovery.
