Businesses, institutions, and government agencies are faced with mountains of "legacy data" -- outdated electronic records, old email, retired databases, tons of saved back-up tapes and the mysterious collections of digital packrats. They are also faced with data preservation requirements in litigation and record retention regulations. How can they (i) reduce their potential liabilities, (ii) reduce the likelihood that they will need to review or produce this information in the litigation context and (iii) still fulfill their legal obligations?

This month The Sedona Conference® will publish the latest project from Working Group One on Electronic Document Retention and Production, its "Commentary on Inactive Information Sources," addressing the challenges brought about by the exponential growth in the volume and complexity of electronically stored information (as well as the warehouses full of hard copy documents) found in modern enterprises. The Commentary builds upon The Sedona Guidelines to provide basic guidance to help organizations develop defensible processes for managing legacy data. The public release of the Commentary will be preceded by a 60 minute interactive webinar featuring a panel of legal experts with diverse perspectives on data preservation who contributed to the drafting and review of the Commentary, moderated by Ken Withers of The Sedona Conference®.
