Cross-Border Discovery Conflicts: The Sedona ConferenceŽ Framework for Analysis

You have offices, plants, computers, and mobile employees on six continents. You are defending a product liability suit in a United States federal court involving a product manufactured in France, facing an inquiry from European competition regulators, and trying to enforce a contract with a supplier in Australia. Access to electronic information from data sources all over the world will be key to successfully resolving these situations. Cross-border discovery has become a major source of international legal conflict, and there is no clear, safe way forward. At the heart of these conflicts are vastly differing notions of discovery and data privacy and protection. And the frequency and intensity of these conflicts is heightened by an expanding global marketplace and the unabated proliferation and distribution of electronic information. Cross-border discovery represents a "Catch-22" situation in which the need to gather relevant information from a variety of jurisdictions conflicts with blocking statutes and data privacy regulations that prohibit or restrict such discovery-often upon threat of severe civil and criminal sanctions. US courts in particular have very little familiarity with foreign data privacy and protection regulations and often are skeptical of a party's claim that access to relevant information from a European parent or affiliate is somehow restricted. The Sedona ConferenceŽ Working Group Six on International Electronic Information Management, Discovery and Disclosure (WG6) has published a landmark Framework for Analysis to help judges and litigants from all jurisdictions navigate the competing currents of international data privacy and e-discovery.
