It's summertime, and while you may be on vacation, the federal courts are handing down more and more decisions on e-discovery. Even the Circuit Courts of Appeal are weighing in on such issues as: (1) the appropriate role of forensic examination in e-discovery; (2) privilege assertion and waiver; (3) expectations of privacy in e-mail and Internet traffic; (4) transparency and defense of litigation hold and e-discovery processes; and (5) the application of e-discovery principles to criminal cases.

To make sure you don't fall behind while you enjoy your summer, U.S. Magistrate Judges Paul Grimm (D. Md.) and David Waxse (D. Kan.) will discuss a select number of significant decisions announced in just the past few weeks and prepare you for the issues you're likely to face when you return to your desk in the fall. And to make sure you have plenty of reading while you're at the beach, we will provide the full text of the decisions the Judges will discuss and an annotated bibliography of more than 200 e-discovery opinions decided in federal courts since the new rules took effect on December 1, 2006.
