In July, The Sedona Conference Audio Update Series examined Columbia Pictures v. Bunnell, CV 06-1093 (C.D. Cal), a high-profile copyright infringement case in which an order to preserve data found in random access memory (RAM) was issued by the Magistrate Judge. In August that order was affirmed by the District Judge in an opinion that focused and clarified the issues, and which is likely to be cited in other cases in which ephemeral or transient electronic information is being sought.

The Sedona Conference Working Group 1 on Electronic Document Retention and Production (WG1) continues to follow this important development in e-discovery law and practice. WG1 has just published The Sedona Conference® Commentary On Legal Holds: The Trigger & The Process, which explores many of the issues raised in Columbia Pictures. This fall, a WG1 team will draft a new Commentary on preservation obligations involving electronically stored information deemed "not reasonably accessible" under Fed. R. Civ. P. 26(b)(2)(B).

This installment of the Audio Update Series will further explore the preservation and discovery of ephemeral or transient electronic information and the implications of the Columbia Pictures decision, concentrating on practical considerations in identifying, preserving, requesting, and producing this data. In response to popular demand, we will devote considerable time on the agenda to fielding questions from the audience.

We are not seeking MCLE accreditation for this program.
